Under the Communications and Multimedia Act 1998 instruments can be issued either
by the Minister or the Commission in the form of a Direction or a Determination.
Ministerial Directions are issued to the Malaysian Communications and Multimedia
Commission on the exercise of the Malaysian Communications and Multimedia Commission's
powers and the performance of the Malaysian Communications and Multimedia Commission's
functions and duties under the Communications and Multimedia Act 1998, whether of
general character or otherwise.
The Minister can issue a Determination on any matter specified in the Communications
and Multimedia Act 1998 as being subject to Ministerial Determination without consultation
with any licensees or persons.
Malaysian Communications and Multimedia Commission's Directions can be issued in
writing to any person regarding the compliance or non-compliance of any licence conditions,
and including but not limited to the remedy of a breach of a licence condition, and
the provisions of the Communications and Multimedia Act 1998 and its subsidiary legislation.
The Malaysian Communications and Multimedia Commission may determine any matter specified
in the Communications and Multimedia Act 1998 as being subject to the Malaysian Communications
and Multimedia Commission's determination.
